About The Breach Process

You should attend all appointments and carry out any other instructions you may have been given by the court or probation.

If you miss an appointment you should get in touch with us as soon as possible and explain why. If you have a good reason you will be expected to provide evidence, such as a doctor’s note or letter from your employer.

If you break the rules without good reason you will receive a warning in the first instance. If you continue to break the rules you will be taken back to court.

If you are taken back to court the court could:

  • Give you a more serious sentence
  • Give you a different sentence
  • Make the requirements of your sentence harder (e.g. increase your unpaid work hours)
  • Send you to prison.

The court cannot just give you a warning or a fine.

An offender who breaks their sentence may be returned to court
